Can I Still Be Charged Criminally if I Wasn't Initially Arrested
My question involves criminal law for the state of: New York
I am a male and an alcoholic and I hang out at this bar near my home. For the past month, I've been getting sexually assaulted by another man at this bar. By assault, I mean he has been grabbing my buttocks and fondling my genitals. This only occurs once he sees that I am inebriated and he knows that I am unable to react quickly enough to fight him off. I have told him to stop numerous times to no avail. Last night, I got sick of it and on my way home I confronted him on the street, asked him if he liked "sexually assaulting me" and I punched him in the face, giving him a bloody nose. The police were called and I told them that this man has been sexually assaulting me and they did not arrest me. They just ran my license, saw that my record was clean and told me to go home. My questions are:
Can I still be criminally charged?
Did my action against him constitute self defense?
What kind of civil action could he take against me?
