Parking in a Handicap Parking Slot
My question involves a traffic citation from the state of: GA

My boyfriend has a temporary handicap parking permit because of knee surgery. One day, I drove his car to McDonalds and he was not on the car. I parked his car at a handicap parking lot(I am not awared of the handicap parking law in GA) and I left the car to McDonalds. I noticed a police standing outside the McDonalds.

When I purchased a coffee and sat down(10 mins later after I parked my car), a guy came to me and said: there is a police outside writing a ticket to your car. I went out immediately and saw the police standing beside the car. I went to him and was asked if this is my car(I said my friend's car). He asked why I parked on Handicap parking and I showed him my boyfriend's parking permit. He asked me to take out my driver's license and he checked against it permit. He also asked where is my boyfriend and since he was not on car, he gave me a parking citation.

Is there any point that I can do self defense?

    Also I have questions:
1.Why did the police wait for around 10 mins(after I putchased the coffee and sat down) to give the ticket instead of pulling me off immediately?
2.The car has the handicap parking permit, why did the police want to give me a ticket before he asked me all information?

    Appreciated for all!

    1. could be he was waiting to see if you were picking up someone who was handicapped.

    2. you'd have to ask the officer

Here in NY I just got my wife a temporary permit due to injuries from an accident that she is still recovering from. When I picked it up I was told that the permit is tied to her more than the car. It can be used in any car by any driver as long as my wife is in the car or being picked up by the driver.

So you parking in a handicapped spot with someone else's permit is probably considered the same as parking there without a permit since you didn't have the permit your boyfriend did.

    GA CODE 40-6-226

    (a) It shall be unlawful for any person to stop, stand, or park any vehicle in a parking place for persons with disabilities unless there is displayed on the driveŕs side of the dashboard or hung from the rearview mirror of the parked vehicle a valid unexpired parking permit for persons with disabilities or unless there is attached to the vehicle a specially designated license plate for disabled veterans or other disabled persons authorized under subsection (d) of Code Section 40-6-222 and unless such person is the person to whom such permit or license plate was issued; the person to whom such permit or license plate was issued is a passenger in the vehicle; or such vehicle is being used for the transportation of disabled passengers on behalf of the institution to which such permit was issued.

As noted, the police were waiting for the disabled person. Further, even if the disabled person is in the car, if they are not getting out, you are not using the permit for its intended use and can be cited in most states.
