Retail Theft Second Offense
My question involves criminal law for the state of: Illinois
my friend and I were arrested yesterday after being caught shoplifting at wal-mart in Carbondale. we stole less than $300 worth of things. it is my friend's first offense but my second. late in 2012 I was arrested for larceny but I wasn't convicted of anything I just had to agree to attend two classes that discuss the situation. that incident happened in Chicago. I was wondering what are the consequences and if we should get a lawyer or just settle for a public defender.

You need a lawyer.
(1) This being your second offense. And now with a friend and $300 shows you are a habitual thief.
(2) Your friend being with you....it can be considered a planned act, which makes your charges worse.
(3) If you can afford a lawyer, you won't qualify for a public defender.
