How Can I Change Child Custody Venue from Indiana to Florida
My question involves a child custody case from the State of: Indiana.
My ex-husband and I divorced in 2005, and I moved (with permission from the court) to South Florida (where I am from) with our son in 2009. I have full custody, and my ex-husband has parenting times rights as outlines in the Indiana Parenting Time Guidelines. My ex-husband will not communicate with me, about anything. I leave telephone messages and never receive a return call. My ex-husband was supposed to have parenting time with our son during this past Christmas break, but I did not send my son because I could not get a hold of my ex-husband or his attorney the day that my son was to fly to Indiana. Our son flies unaccompanied minor, and I feel that communication is imperative.
I should add that while in his father's care, my son was molested. My ex-husband took part in supervised visitations and followed the requests of the court to be granted unsupervised visits. While my son enjoys seeing his father, he is never fully comfortable spending an extended amount of time there. He is always forced to spend seven weeks in the summer because his father will not bend. :grumpy:
My ex-husband is unreasonable. For example, last year, he had parenting time for spring break. He is entitled to 'the entire spring break' and he believe that means that he should also get MOST of the day on the Sunday that my son is to return to Florida. He, and his attorney, requested that I purchase a flight that returned my son at 11:00 pm that Sunday evening. My son was not home and in bed until 1 am. He was unable to attend school the next day. I requested that this year, we bring him home earlier in the day so that my son has time to reacclimate himself prior to school the next day. They are refusing. I try very hard to communicate and work with my son's father on all issues. He refuses to communicate with me at all. The bitterness is not good for my son, so I refuse to take part. Instead, I continue to try to communicate with him. I always allow extra time when it will be beneficial to my son.My ex-husband keeps us in court regularly. If he is unhappy with ANYTHING, he files a motion with the court and makes me fly to Indiana for a court date. I have no attorney. I simply cannot afford one. My ex-husband only recently hired an attorney. He hired the attorney for the sole purpose of being the person that communicates with me. The attorney is frustrated. I am frustrated. :wallbang:
My question is this. My son lives in Florida with me. He attends school in Florida. His doctors are in Florida. Is it possible to have our case moved to Florida since this is the primary residence of the child? Child support is current, though it needs to be modified.
