    Just Found Out Paternity After 12 Years
    My question involves child support in the State of: Kansas

    So I found out I am the father of a 12 year old boy, someone else has been raising him and is on the birth certificate. She is threatening to get me for back child support, can she get that? or only current support once I establish paternity? Thanks

    Could you give us a few more details, Mike?

    Was/is she married to the guy on the birth certificate?

    How did this all come about?

    How involved is Legal Dad?

    I don't believe they were ever married, they were together for a long time and when she went after him for child support he asked fro a paternity test and found out he wasn't his. I don't believe he is involved at all anymore

    But he's still the legal father, correct?

    It would appear that the time in which Mom (and him) could disestablish paternity has passed.

    Now the question may be, what do you want to do about things? You may be the only person with standing at the moment to challenge paternity.

    Ok, what if I say I want paternity then does she have the right to get back support from me? That's the real question I have is about back child support if I actually am determined to be the father and I accept that responsibility.

    From what I'm finding in the Kansas statutes, that state does allow for child support to be made retroactive to birth (!).

    HOWEVER. Paternity has already been legally established - what you really need to do is find out whether or not Legal Dad is still Legal Dad.

    Okay - they WERE married when the child was born?

    And they're now divorced?

    They are now divorced, he was born Nov 1999. He asked for a paternity test when they got a divorce, around April of 2011

    So was his paternity legally DISESTABLISHED in the divorce proceeding?
