Father Deviates from Court Ordered Visits
My question involves a child custody case from the State of: Ca.

I will try to keep this short. Court order states that we have joint custody, with visitation or "shared living" dates set by the court about a year ago. My 7 year old daughter lives with me most of the time, she is to be with dad every Wednesday after school until 7:30, and then every other weekend from Friday after school until Monday when school starts, if there isn't any school he will drive her home by 9 a.m. Monday morning. Ok so that is what is stated in the order.

Here is my problem, he changes things last minute, ALL THE TIME. Every visit for a year now has become a nightmare. Either he texts me while I am work saying he can't get her from school, or he won't drop her off at 9 a.m. but rather when he gets off of work in the afternoon. He is responsible(court ordered and his idea) for all transportation, to and from visits. He has numerous excuses, his car broke down, he has to work, he will be out of town and he doesn't let me know until it is too late for me to fix things so I can pick her up and get a sitter. I work alot and am unable to if I need to deal with his visits gone wrong. It isn't that he doesn't see her, he just keeps her well past the time he is supposed to, or he cancels and wants to reschedule but then never does. When I tell him he needs to figure it out, he tells me he is going to take me back to court to change the order so he doesn't have to pay me child support. I document everything, every time he deviates from the visitation scheduled court order.

My question is, when he keeps her past the time should I call the police? Or what should I do? If he changes the time or calls me last minute to tell me I have to get her from school, what can I do then? I need to go back to court and adjust the orders but who likes to do that? Like I have stated I document everything, is there anything in paticular that I should be writing down, a certain format?

The police won't do anything (and honestly, they shouldn't).

Your recourse is to head back to court.
