    Can I Get Emancipated to Move to Another State With the Father of My Child
    My question involves juvenile law in the State of: West Virgina

    Hello my name is Kelsey and I‘m sixteen years old. I live in West Virginia with my mom, boyfriend, and daughter. The reason I’m posting this forum is to ask if I would qualify for emancipation. The reason I would like to be emancipated is to move to back to Ohio so I can take care of my daughter. better. When we moved here I couldn’t get into school because I needed a TB test done and the doctor said we might not want to risk it considering I’m pregnant. So my mom had me dropped out of school while i was a Junior (11th grade).


    We just moved to west Virginia a couple of months ago near the end of my pregnancy. Things were alright when we first moved, but after about two months, Ryan (my boyfriend) couldn’t find work for awhile and we had barley any food in the house. My mom makes to much money to get food stamps, but all of her money goes to bills and she still helps my grandparents with their bills and groceries. Ryan had a job working a few days a week making little money, but enough to get some food in the house.


    Then in November I had my daughter. Which at that point his boss finally gave him more hours. Which helped with buying diapers, wipes, and other necessities. Soon my mom was asking for him to give her $90 every month, because she let him live here. He got paid about a hundred and some every paycheck. every time he got paid we would have to buy diapers and wipes and go grocery shopping for the whole house. I tried to get a job as well since I dropped out of school. I couldn’t find work anywhere and we’d still have to find a baby sitter and pay for the baby sitter.


    This month (February) Ryan quit his job because he was going to get his income tax and he had been waiting for the place that said they were going to hire him call. Only to find they called to say the person that quit came asking for their job back and that their sorry. His old job would not heir him back since he quit and now we don’t know what to do about money. When he checked online his income tax return still has 21 days until he gets it. His income tax return is $2,300. As soon as he told my mom she said that he’s going to give her $800.


    We want to use that money to move back to Ohio, but every time we ask my mom if we can get married she says we’re not leaving till I’m eighteen. I want to get emancipated so we can move. We already have a place to live their and Ryan has a job waiting for him in his uncles auto shop. I could also go back to school, and since all of our family is there we could find a baby sitter for free (Ryan’s mom begs us to come back and offers to watch our daughter every days so we can get everything together). He worked in the auto shop before we left and made good money, but since we have someone to watch rose (our daughter) I could also get a job to help out with everything. Please let me know if I have a good enough reason to get emancipated I just want the best for my daughter and I don’t want to over a year for us to get the best help we can for her and ourselves.

    Emancipation is not and never was intended to be a means for a minor to leave home. It was and is intended to be a means to provide legal protections to those minors who, for reasons outside their control, found themselves living alone.

    You are not financially self-supporting. You are sixteen and already have a child. You do not have parental permission to move out. You dropeed out of school. Four very good reasons why your petitiion for emancipation would be denied.

    No. You do not have anything even close to a good enough reason to be emancipated.
