    Caught With Prescription Drugs That Weren't Mine
    My question involves criminal law for the state of: New Mexico

    I got pulled over for a crack in my windshield and I had a bottle of prescription pills in my glove compartment that are my friends. When I was getting my papers I threw the pills on the floor but the cop wrote that I was trying to hide them under my passenger seat. He took the pills and stated there were 5 different pills. I had my friend look up the names and MG and none of them are narcotics. But they were all also expired except for one pill that she uses for her migraines. I have court now and I'd like to know if the pills are expired what does that do to the ticket/case and if it does nothing then if none of them are narcotics am I okay.

    Nope that just makes more of a prima fascia case you are illegally in possession of them.

    If the prescriptions are expired or the prescriptions do not belong to you and the pills are controlled substances (there are many controlled substances that are not narcotics) possessing the pills is a crime.

    You really need to get yourself a criminal defense attorney or if your income is low enough you may qualify for a public defender.

    Possession of an expired prescription is not, in and of itself, illegal.

    They weren't prescribed to HIM though. Just because a prescription is expired doesn't negate that it is still a controlled substance.

    It really depends on what the pills actually were. People often throw a handful of various things into whatever bottle they have handy (instead of using a pill dispenser) when they are going somewhere. If it was an antibiotic bottle that contained one or two antibiotics, a Sudafed, a beano and a Tylenol that's way different than other possible combos.
