    My question involves criminal law for the state of: Washington

    I got caught shoplifting today because I made a really poor decision. It was at Macy's and it is the only time I have been caught. I am over 18. I took a shirt while in the fitting room and an LP guy stopped me in the middle of the mall and took my purse and made me go back into their office with him and 2 women. They told me I had to pay x amount, x for a fine and x for the value of the item. They told me I wasn't be arrested and that they weren't notifying police, I am also not allowed back into Macy's for 3 years. One woman said that I had stolen another item from Macy's 3 years ago, although she did not stop me at the time she brought up a conversation we had before I knew who she was, so I remember the day but I do not remember stealing the item. I may have stolen multiple times from Macy's over the last 5 years but I don't know what they have me on video stealing or which item they are talking about. I am supposed to bring anything I have stolen in tomorrow for them.
    Do I bring in every of this specific I could possibly have stolen that day to them? Do I bring everything I've ever stolen in? I learned my lesson because im not ordinarily such an idiot but I also know I could be in big trouble if I bring in over a certain value of clothes. Can I ask them what it is they think I stole? What do I do?

    Right now - the best thing you can do is start calling to make an appointment with a Criminal Defense attorney for as soon as possible.

    I would be concerned that when you take that stuff to the store - you will be arrested. (1) Criminal Trespass since you are banned from the store. (2) The amount/value of the items you return - now they have your ass nailed to the wall and will call the cops.

    In the meantime, if police come knocking on your door - the only thing you say is you want to call your attorney.

    You're already in big trouble. Stay out of Macy's. You do not want to bring them any more evidence to use against you. If you get a call from the police or the prosecutor's office, decline to speak to them without an attorney.

    They can't get OP for CT if they gave permission to return the items stolen. Getting OP for the additional items is a possibility. Macy's does have rules on when to call the police on apps but many stores tend to do their own thing.

    Best bet if OP is going to do it would be to bring the stuff to the first register inside the door, tell the cashier it's for LP and walk back out.

    Interesting. I thought it would be a nice way to lure OP in, and immediately detain for Criminal Trespass as well as the stolen goods.

    Short of getting caught stealing again, the stores I've worked in didn't do much beyond telling the person they need to leave. If they refused, the police might be called. I never encountered anyone who didn't leave after a warning.

    Point of curiosity.....they wanted you to pay right there and then? They brought up you possibly shoplifting 3 years ago? And they want you to come back, bringing in (shoplifted?) merchandise to turn it in to them?

    SOP at Macy's is to ask for the civil demand at the time of apprehension, barring any local laws to the contrary.

    I agreed to pay it the next day but I paid it the same day instead. I just spoke to a friend who works in defense law and she said that they can't prosecute me for anything I took in the past that they didn't catch me for. So I thought I was done with all this and called the store and said that I paid the fine but they said that I admitted to stealing and said I'd bring anything back. Since anything I might've taken before would be damaged does that give them the ability to press charges? Should I just go buy something tiny and cheap from somewhere else and give it to them?

    I would avoid the store, period. Unless accompanied by a lawyer. Or like Freeman said - hand it to the first cashier you see...and haul ass out (but...I would think you would be on store and mall surveillance cameras anyway).

    Since you stole the items, a lot has happened. Price tags removed. Worn, washed - therefore, not in saleable condition. Think of new vs used underwear.....you would not want to buy the panties someone has worn for 3 years at full price right?
