Does Getting Married Prevent Prosecution for Statutory Rape
My question involves criminal law for the state of: Michigan
My daughter was 14 and her boyfriend 20 when she got pregnant. They want to get married when she turns 16 in March. If they put his name on birth certificate after that will he be in trouble?
Re: Will Dad Go to Jail if His Name Added After They Get Married
Yes, if they figure out who the child molester is, he will be in trouble. Further, her parents may be in trouble also, for not pursuing the sexual predator. Even if he is not named on the birth certificate, the court can compel DNA evidence of his crime with a warrant and charge him. Her parents should avoid charges and report the crime.
Re: Does Getting Married Prevent Prosecution for Statutory Rape
When you rape a child, you rape a child. Marrying the victim doesn't change what you did.
Re: Does Getting Married Prevent Prosecution for Statutory Rape
The answer to your subject heading question is, No. He committed a felony under Michigan law. Marrying the victim does not make that go away. It's still a felony.
Re: Does Getting Married Prevent Prosecution for Statutory Rape
There are some states that provide relief from statutory rape laws if the parties are married at the TIME THE OFFENSE IS COMMITTED, but Michigan isn't even one of these.

You. Let. Your. Daugher. Have. Sex. With. A. 20 year old.
Mama/Grandma....I would be expecting a visit from Department of Children and Families, and expect your daughter and grandkid to be placed in foster care.
