Repayment of 1/2 Medical Bills
My question involves child support in the State of: MA
I am wondering how should my husband proceed in formally requesting payment of half the medical expenses for his children. He has asked her several times however there has been no attempt to pay. So we would like to know how to address this issue with a formal letter. Right now we have custody and she currently pays no child support however our court order states she is responsible for half of all UN-reimbursed medical expenses. She hasn't payed any in the year since we received the permanent custody order. I would really appreciate any and all help. Thank you.
Re: Repayment of 1/2 Medical Bills
How about documenting the nature of the care, the amount of the unreimbursed expenditure, and attaching a copy of the receipt?
Is there any CSE involvement in the case?
Re: Repayment of 1/2 Medical Bills
Dad may have to take this back to the judge. Sending her proof of expenses and solid documentation that you notified her is the place to start. If she doesn't do anything, head back to the courthouse. If dcse is involved, they may help you collect on her debt to you, but you need the judge to say that she owes it first.
Why does may not pay support? Consider filing for a support order. You can go through dcse or the court.
Re: Repayment of 1/2 Medical Bills
If there is a court order that is not being followed, then your husband will need to go back to court and show the judge that the order is not being followed. This included failure to pay child support and 1/2 of the medical expenses.
Its important that all payment requests are documented. For example, it helps if payment requests are mailed certified. He can request services through his state child support enforcement office.
Please keep in mind its not "our order" its "his order".
