Renting a Surrendered Home During Bankruptcy
My question involves bankruptcy in the state of: Florida

Thank you all for your site, I'm very pleased with the information.
My wife and I filed jointly for ch. 13 in August, 2011, confirmed last year, we surrendered our home, along with other real estate properties that we owed. A needy friend of ours asked to rent our home for a low fee. We agreed to do it since the house has not gone through foreclosure proceedings. Is it legal to rent our home since we surrendered it to the bank? Thanks.

If you enter into a landlord-tenant relationship with somebody and they are removed due to the fact that you have no right to possession, they have a potential cause of action against you for breach of contract.
