Kicked in Bathroom Door, Police Called
My question involves landlord-tenant law in the State of: California
My ex and I got an apartment together (1BD/1BA) and it has been nothing but trouble. I talked to the leasing manager of the complex yesterday about moving out and taking my name off the lease and leaving my ex responsible for the place until the lease is up in 7 months. I wish I could move out NOW but I have nowhere else to go being that we moved to a new city, hours from "home", and I have a job here now that I CANNOT just quit all of a sudden because of this escalated drama. I try to crash on friend's couches as much as possible and haven't slept in the apartment in days (so I do the best I can to avoid him).
This morning I was getting curling my hair in the bathroom when he walks in and tells me I need to get out so he can pee and shower... I told him he could do all that just leave the door unlocked so that while he was showering (which can be for 30+ min) I can continue to get ready for the day in the bathroom. Somehow we started arguing over nothing and I when went into the bedroom to get something & he rushed into the bathroom and locked the door... Being that we don't get along and I don't trust him around my things (He just poured beer on my car last night, I find trash and chips in my clothes hamper, he has tried taking my keys from me before, etc...) I had my purse in the bathroom so I could keep an eye on it, which was now locked in with him... I felt like I had no choice but to kick the door in to get my personal items. Since I kicked the door in the frame is now broken. (See photo) http://i49.tinypic.com/ml1c49.jpg
I left the apartment once I was finished getting ready (45 min to 1 hr after the incident) and was gone for about 2 hrs and came back to a note on our apartment door that my ex had left for the police to contact him because he had to go to school. The police wrote back that they were unable to reach my ex when they came by and to call a specific division when he is ready to make a report...
My question is: What trouble can I get into with the police for doing what I did?
Re: Kicked in Bathroom Door, Police Called
That will depend upon what your ex- tells the police about the incident, and what your landlord thinks about the damage you caused if the police contact him about the damage.
Re: Kicked in Bathroom Door, Police Called
You are generally permitted to damage the premises you live in, as long as you pay for it to be repaired and the action did not involve an act of domestic violence. Basically, you are saying he went into the bathroom, locked the door, entered the shower and since he did not react to unlock the door so you could retrieve your purse, which you needed for work, you made the determination to break the lock, get your purse and appear to work on time, thus avoiding termination for being late, correct?
Re: Kicked in Bathroom Door, Police Called
I would guess a few other possibilities:
- Eviction.
- Pay for the repairs or lose your security deposit.
