    When Can an Undocumented Immigrant Get Status Under the New Immigration Law
    hi, i was on planning to the leave the US this month with an expired visa, i overstayed in the US for 3yrs now, but i after i heard obama's proposal of the immigration reform to the 11million undocumented immigrants it changes my mind. my question is..

    1. am i elible if this bill gets approved? when it comes to background check i have no criminal records, no taxes, no penalties in driving, did some few caregiving but only under the table

    2. if i am elible, how fast/slow this process do you think will take in getting a working permit and a green card?

    some may agree or disagree on this reform but im just looking for an opinion. :)

    Immigration reform has been "on the cards" for years now.

    There's no guarantees.

    IF the bill is passed - which, honestly, I doubt - nobody can tell you if you'd qualify or not.

    Obama isn't doing anything. The issue is what the senate comes up with (and whether it gets buggered by the house). You can pretty much count on Obama signing it. He can take credit for the good stuff and blame congress for the bad.

    No statute has been written yet. Until someone writes a bill, it is a little hard to tell you if you qualify for what has not yet been defined. How fast or slow you will qualify for the unknown thing that has not yet been written is also a little hard to predict, but I'm going to stick my neck out and predict it will be one or the other.

    Another complication is that Obama is the president, so he doesn't get to write or pass bills. All he gets to do is to sign into law the bills congress passes, or else veto them (or ignore them and let them become law anyway). So Obama's proposal means nothing. What the congress passes is what matters. When they get around to writing a bill, that is, which nobody has done. Right now it is all just political positioning... as it has been for decades, I might add.

    sorry for the late reply, and thanks for the responses..

    as what i've read on some articles, that it may probably take 10years for non-immigrants to get a permanent residence (greencard), coz they need to secure the border first.

    quick question, if ever i have a working permit can i still leave and re-enter the US?

    There is still no law. We cannot tell you what the law says until there's a law we can look at.
