Chances of the Judge Sealing My Juvenile Record
My question involves juvenile law in the State of: CA
I was charged with Vandalism PC 594 when I was 13 and Burglary PC 459 (reduced to a misdemeanor) when I was 17 . The punishment was 100 hours of community service and probation for six months which has been completed. I am now 19 years old, currently attending a community college, and have matured since those charges. I hired a lawyer to help seal my records last year in March 2012. The lawyer said that the judge shouldn't have any problem granting my petition. The lawyer included a copy of my college transcripts (pretty good grades) when he filed the petition as well. I called the court a few days ago to see what's the status of my petition and the clerk said it's still being processed. She said my file(s) is probably in the archives which is why it's taking so long. She also told me that the process usually takes about an average of 12 months. Should there be any reason why the judge will deny my petition? Also, when should I expect to get a notice from the court? I am assuming it should be soon because it has been almost 12 months since the day my lawyer filed the petition. Any answer is greatly appreciated. Thank you!

It is rare that these petitions are not granted. However, if the probation for the burglary was completed/terminated less than 12 months from the time of the filing, that may cause some problems. Otherwise, I suspect that the petition will be granted soon enough.
