Trying to Regain Custody of My Son
My question involves a child custody case from the State of: Massachusetts. In January of 2012 I lost custody of my son to his father because I had, according to the court, moved too many times. Though every time I moved it was because of violence displayed in the household I understand that part. They also told me I had to get a mental health evaluation because my mother, who was trying to gain guardianship claimed I was bipolar and undiagnosed. The order was given that I was to have supervised visits with my son while completing what was required, but they left it up to his father to choose when I was allowed to see him. It has now been almost 6 months since the last time I was permitted to see my child and almost as long since I talked to him, and not by my choice. I am currently working on getting my evaluation through the courts psychologist since I was not told last year that any other psychologists report would not be considered a valid evaluation. My question is, what are my chances of getting at the very least, shared custody of my son back after I complete my evaluation? And would I be correct in assuming that I can file contempt on his father for not letting me see or talk to him in this long. I don't know if it is important but I do still have shared legal custody of my son.

In order to change custody you'll have to show a change in your son's circumstances.
Dad's not really in contempt if it's left up to Dad as to when you're allowed to see him.
