Deferred Adjudicated Probation
My question involves criminal law for the state of: Texas
I have recently been put on 4 years deferred ajudicated probation for overpayment of unemployment benefits in 2008. The charge is theft. I have to pay $11,174.00 in restitution at the rate of $300/month. The probation officer said as soon as I pay the money back, I can request an early release from probation. So if I pay it all back at say $1000/month, can I get early release in 11 months? Also, how will it show up on a criminal background check for jobs while I'm on it and when I get off?

You can ask your probation officer to clarify whether the judge might discharge you if you have all of your fines, assessments and restitution paid 11 months from now.

The record of a deferred disposition will typically show the charge, the deferral, and the eventual dismissal.

So should I tell potential employers upfront about the probation?

Ask your probation office or some one with knowledge about getting an order of non disclosure it will help seal the record somewhat but many places can still see it.
