Consequences of Not Taking the Job After a H1-B Transfer
    Hi,

A company A filed my H1-B transfer and it is approved now.I have never worked for company A. I have another company B willing to file my VISA. I have below questions.

    1. Is there any issue if company B files my transfer, though I can not provide the approved petition by compoany A. I can only give the petition of my current company.
    2. I have accepted the offer from company A so as to file the transfer. Can they cause any legal trouble if I do not join them.

I would really helpfull if I can get any help on the below questions.

    Thanks,
    Tej

Depending on your contract with them (if any), they can file for damages for your failing to comply. Have all of your contracts reviewed by an attorney.

Ok.. that answers my second question.

    1. Is there any issue if company B files my transfer, though I can not provide the approved petition by compoany A. I can only give the petition of my current company.

I mean if USCIS can deny the approval from company B as another company A has got my VISA already transferred?

    Re: H1-B Transfer
There is no law that they must do so. Do you not understand that it cost money to file for a transfer. People should really decide what they want to do. Your behavior reflects on future applicants to the company. If enough people from your country have company A file useless petitions, they are going to avoid hiring your countrymen.
