Missed Car Payment During Chapter 13 Bankruptcy
My question involves bankruptcy in the state of: New Jersey. Hello I have question about a missed car payment. I am presently in a chapter 13 bankruptcy and I pay a trustee every month for the next 4 year.I received a letter from my car loan's lawyer stating that I was behind. I called my lawyer and set up a phone conference. In speaking with my lawyer he deceided that if I doubled up on the payments for the next two month that I would be caught up which I did.This process began in October. It's January and I received a letter stating that they were awarded $500 for appearing in court two times to finalize this agreement with my car loan's lawyer. Of course I don't have to pay it all at once they will add it into my trustee payments.Does this sound like a lot of money? Could I object to the amount and they could reduce it some? Just trying to find out my rights. Thanks for reading my e-mail.

When you say you "received a letter" did you actually receive a Motion for Relief From the Automatic Stay? If a Motion was filed the legal fees associated with the same are very reasonable and, yes, you have to deal with them. Even if it was just a 1 page letter and a couple of phone calls between lawyers, depending upon the hourly rates charged by the lender's attny, the amount may still be reasonable.
The problem is if you want your attny to argue over the fees he is going to charge you for that additional work. What he charges you will most likely be close to or more than $500.00 so it makes little sense to quibble over $500.00.
