Caught Shoplifting With a Friend at Walmart
My question involves criminal law for the state of: GA
Me (16) and my friend (16) were caught shoplifting approximately $40 of merchandise each. We were stopped by a employee and we promptly handed over the stolen items. Police were already on the scene and handcuffed us and brought us to a office in the back of Walmart. They made copies of our ID's and filled out paperwork. They said we will have to appear in court for criminal charges and Walmart also will push a civil charge. They called our parents and let us go. I understand this was a bad decision. Now i'm looking for advise on how to defend myself and what will be my punishments. I was charged with breaking curfew in the past. I appreciate all advice.
Re: Caught Shoplifting from Walmart
Your parents should get an attorney for you.
Your parents can expect court costs and fines. There will also be a letter from WalMart or their lawyers for the Civil Demand, which is separate from the criminal case - this is for damages (including cost of surveillance, detaining you, LP wages, insurance for the LP's...the merchandise that could have been purchased by a legit buyer....). If they don't pay it, the amount goes up, up again, and then they sue in court and legal fees are added and your parents credit history can be ruined. So best to advise the parents to pay it.
YOU...can expect any of the following: Anti-shoplifting class (your parents pay), Community Service (your parents pay for this privilege), probation. AND a criminal record. Your job options will be limited.
Best go apply at McD's now. Your parents are not gonna be happy with the $2000+ that you are costing them.
