My question involves juvenile law in the State of: Nebraska
I attend the University of Nebraska-Lincoln and I was at a party. I drank at the party and received a ride home. The car that I was in was pulled over and the driver was questioned and tested for a DUI. After about 45 minutes, during which I was sitting in the front seat of the car, an officer knocked on my window. I opened the window and he said, "blow this," and stuck a breathalyzer in my face. I did it and he took my license, came back with a ticket and told me to appear in court on February 13th. He did not tell me what I blew, he did not write on the ticket what it was for, he wrote the ticket in pencil so it is all worn off and he never read me and rights. He then told me to open the car door and get out. I did and he told me that I needed to walk home. I told him that the kid driving me was my roommate and had our key and he told me to "find another way to get in because he is getting arrested." My question is, I'm guessing I got an MIP, this is my first offense, so how do I get this removed and should I just plead guilty and take a diversion class or should I plead not guilty because I was never read my rights, he wrote my ticket in pencil, didn't write what I blew or what the ticket was for and then he made me walk home when he knew that I did not have a room key. By the way, I'm 19 years old. Thank you all for your time and help.
