    Roommate Filing Restraining Order on Me
    My question involves criminal law for the state of: California

    I know this sounds stupid, be cause it is and yet is is very serious Please help me! Me and my roommate arguing and after she left for work she continued it threw text, so just to piss her off i told her i farted on gummies bears she ate not that i really did. I later texted her that i didn't really do it, and then the next day she comes home with a subpoena saying she is filing a restraining order on me for civil harassment, and the subpoena doesn't even have my real name on it. And the only reason she is doing this is because i am dating her best friend and wants us broken up. Do you think the judge will actually put the restraining order on me? What can i do to help my situation? Oh and her dad is a lawyer.

    A civil harassment order will require some articulation of fear on her part. But, sending her harassing text messages can be sufficient to accomplish that task.

    If you are served with a restraining order, be sure to obey it, answer it, and attend the court hearing.

    I always like to start my mornings with a smile, but in this case it's a full on gut bustin' ROTFLMAO!:D:D:D

    Farting on gummy bears.....priceless! Even though ya din't do it.

    Seriously though, most restraining orders come with a court appearance in the not too didstant future wherein you'll get to explain to the judge your side of the predicament.

    May I suggest this? Time to start apartment hunting? And looking for a new roommate for her....
