    I Hit a Black Car Blocking the Driveway at Night, Who's at Fault
    My question involves a traffic accident in the State of: California

    I just left my girlfriends house, it's about 12:40 am, pitch black dark. I hop in the car, check my mirrors, turn around and assume its safe to pull out. I begin pulling out when I'm greeted by the sound of aluminum bending. I quickly drive back up into the driveway. When I step out I see that one of the neighbors black pickup trucks is blocking more than half the exit of the driveway! His small Mazda pickup truck is left with a bit of paint scrape from my 01 Camry and my Camry is left with his black paint and a dent the size of a pumpkin. Considering it being nightime and the color of his truck. Who's at fault?

    You are. You were moving. They were parked. Kind of hard to be at fault for an accident when you aren't even in the car.
