Can You Get Unemployment Despite Quitting a Part Time Job
My question involves unemployment benefits for the state of: Pennsylvania

Hello all and thanks ahead of time for reading.

I picked up a part time job over the holidays to help supplement my income before I went to school using the TAA program. I quit the job last week in anticipation of going to school. The job I had, had me scheduled overnight and there would be no way that would work with my school schedule which is why I quit. I had told them from the beginning I didn't want to work overnights moving into the new year and I reminded my night manager of this and the schedule was never changed which is why a reason I quit. I will be the first to admit I am a moron for not researching this earlier. Anyhow, I am going to assume I am going to be investigated and am currently scurrying to pickup a different p/t job in order to make a quick switch between jobs to avoid any further issues. Does anyone think that will help my upcoming case?

Here is a link that shows PA's unemployment guidelines and rules... http://www.portal.state.pa.us/portal...=552113&mode=2

The paragraph under Attending School does bring up my TAA benefits but I am confused by the language in those rules. In particular the part that says "If the claimant quits to attend TAA-approved training, he/she must show that the job he/she quit was not suitable work to be eligible for UC. Suitable work for the purposes of this exception to Section 402(b) means work of a substantially equal or higher skill level than the claimant's past "adversely affected employment," and wages of such work are not less than 80% of the worker's "average weekly wage.""

If anyone could help provide any insight ahead of time it would be greatly appreciated. If I get denied benefits I already updated my resume and am bookmarking jobs to apply to.

An example of unsuitable work in the above example would be a hygenist making $1000/wk and was layoff. Then qualified for training after having accepted a dental assistant position making $500/wk.

The assistant position is a lower skill level than a hygenist, and the earnings are 50% less than the claimants average weekly wage of the adversely affected employment.

However, rushing out and getting a replacement part-time job doesn't fix the problem. Just go through with the adjudication, and once it's over concentrate on your training. Too many people think that part-time jobs are the key to supplementing their unemployment checks, but it creates problems that most people can't deal with. It quite often leaves them with no pay check and no UI check.

(a part-time job with irregular hours also makes getting food stamps renewed a royal pain in the ass)

Ok, there was more then I had previously wrote about after talking to Pennsylvania's unemployment office. Chances are there will be an open investigation as to why I quit when I should have been available for work. Secondly, I was eligible for TAA and TRA Training benefits. The TAA is affected by the Unemployment and if I am no longer eligible for Unemployment I am no longer available for TAA assistance as well. However, I do get get to keep my TRA Training benefits. In other words I still do not have to pay to go back to school and may have to find a part or close to full time job to help with my income. Like Chyvan said people should research p/t unemployment first before just jumping into the water. A simple 5 minutes of research goes a long way. Another thing I can highly suggest is try not to dwell on the stress you have created for yourself. Admit your fault, stay focused and as always try to have backup plans and if you don't, start planning now. In the meantime there is a 3-4 week review period for my first extension which I also had to file this week and also disclose all this information to the unemployment office. After the 3-4 week process I find out if I can continue to receive unemployment benefits or I lose them. I will update this thread till there is a resolution to my issue just in case in helps anyone in the future.

Ok, so almost two months later and no resolution. I have been told when I have called into unemployment they were awaiting a response from the employer and they have not given the information that PA Unemployment has requested. They where given a 72 hour window last week to provide the information otherwise PA Unemployment reviews my unemployment without the input from the former employer. Sounds like they are trying to confirm how and why I quit via the employer to verify if the information I provided is true or not. Anyways, since this is just about the 8th week I have not received any new information and I am still under review I am only hoping that I can expect a resolution sometime in the near future. I have called once a week the past three weeks and depending on the person I speak to I get varying levels on information. The more seasoned reps can provide me with more detailed info while it sounds like the less experienced just tell me to call back in a few days. I cannot wait for this to be over with and can only hope it will be resolved in the near future as my budget and savings are reaching levels that make it very tough to survive on.
