    Removed a Tag and Added More Packets to the Hot Cocoa Pagage Before Paying
    My question involves criminal law for the state of: California I was at Kohls and I was buying a box of hot cocoa I added more packs before paying. I also ripped off a tag of a item that was next to the item I was buying on the rack and told the cashier this was on the same rack. After paying I was stopped out side of the store and was brought to the back roomwere they called the cops for shiplifting. I know soooo stupid. The cop gave me a sitation and a court day with Petty thift 488. This is my first offense but I really dont want this on my record. Any adivse will help. I am 36 years and should know better

    Is this being charged as a misdemeanor or infraction? If you don't "want this on your record" the best advice was not to steal to begin with. Knowing better isn't sufficient, we expect you to act on that knowledge. The second best advice would be to contact a lawyer. Reduction to infraction or arranging a diversion is what they can hope to do.

    The ticket has misdemeanor.

    The time to consider the ramifications of a criminal charge and conviction on your record is BEFORE you commit the crime.

    You may get lucky and your county may have a shoplifting diversion program available to you. The DA might also be willing to offer an informal diversion, too. You can expect to pay court costs, fines and fees as well as a civil demand of up to $500.

    I understand I should have thought of my actions first. As i look back today I am angry with my self and my stupid decisions. I am hoping the judge will give me an infraction and I will pay the fine. I have learned from stupid actions yesterday. Thanks for your help
