    Was Given 30 Days but Need 4 More
    My question involves an eviction in the state of: NC
    My husband and I live with this couple we met at church. We have been living here for 6 months, and have received tons of mail while we have been here. They never asked for rent. We have bought food for the house every month but last month. Nov 30th they said we had until Jan 1st to move out. We said ok. It was a verbal agreement, not a written. We also have 3 witnesses. As of yesterday the 29th I asked the man that we stay with if it was ok if we waited til the 4th of Jan. I explained to him that even though I told my job that I couldn't work after the first of the year, they had out me on the schedule for the 1&2. On the 3rd of Jan it is raining. He agreed to let us move on the 4th since we have a definite ride. As we were going to walk out of the room, his crazy bi polar wife came in and started yelling about us making excuses. After about 5 minutes of her treating me and my husband like dogs, I stood up, said to her that I'm not listening to this and proceeded to go upstairs to our room. She followed us up there and continued her to verbally abuse us. She has stolen a notebook from us. The way we know is because one day she threw our resumes at us. The only copies we had of our resumes were in that notebook. Also she has gone through our mail. The way I know is because she asked me about a matter I never speak about in public and only my mom, sister and husband know of. Ok, now that you know the back story, here are my questions.
    1. If she calls the cops, can the make us leave? Even though we have been here for 6 months?
    2. How can I get my notebook back? Ask the cops to look through her stuff?
    3. How can I prove she went through my mail to find that sensitive info?
    4. If we take her to court, can we sue her for every thing she has done? Mental abuse, stealing and tampering with mail.

    1. They would need to evict you.
    2. The cops won't touch this.
    3. You can't prove anything, including that it's raining on January 3rd (since it's December 30th today).
    4. You can sue her for whatever you wish. It's winning that lawsuit that won't happen for you.

    Let's be honest here. You two were a couple of deadbeats who lived off the good graces of this couple for six months and when this family got tired of you two and everyone agreed that you'd be out in thirty days, you still attempted to squeeze out a few more days from the soft hearted husband and the lady of the house blew her top.

    And you actually want to sue this woman for letting you live there rent free? Amazing. Clearly proves the old adage no good deed goes unpunished.

    Wow... I don't know where to start. Clearly you didn't read this well enough.
    How about the fact that we are not "deadbeats" as you put it. I have a job and my husband is in college. Far from deadbeats I assure you. Deadbeats would sit around all day doing nothing and/or snorting pills and doing drugs. I know, because my husband's biological mother is a dead beat. I asked for 4 more days because my job in this city put me on the schedule for this week even after I told them I couldn't work at this store anymore after the first of the year. The big boss said I could get a transfer to her other store in the city we are moving to. Also, only someone with no heart would make a person move all of their stuff when it's supposed to be pouring down rain. If you met this woman then you would understand how we feel. I feel worse for her husband than I do for us because we can leave and get away from her. He's stuck with her. Like I said before, she has major control issues and she is very bi polar. Just last week she apologized for how she has been acting. We forgave her then she turns around and acts like this. This has been ongoing for the past few months. We are sick and tired of it... You try living here then come back and tell me what you think. I'm sure by then you'll agree with me.

    Actually, the generally accepted definition of a deadbeat is someone who isn't paying their own way in life.

    It has absolutely nothing to do with lack of work or doing drugs.

    How about the fact that you HAVE been living off of them? And the guy's wife is somehow the bad guy here? I don't get it.

    So here's what you do:

    You go rent a truck. Today. You load it. 2 people in one bedroom - it should only take a couple of hours. You can do this around your work schedule.

    You then go to a motel for the next few days, get up and go to work. Once your done for the week, you take the truck to the new place in the new city. I assume you have already signed a lease or something? If not, I suggest you get working on that real quick. www.forrent.com www.apartmentguide.com

    She treats everyone like crap. We had a meeting with our pastor and she treated everybody there very rudely, but here it's worse because she doesn't have anybody to witness what she does: and I do have a voice recording of our meeting.

    I like the idea, but we don't have any money for a truck. I only work 6 hours per week, and even though I don't pay her rent, I still have bills. Also, no money for a motel. As far as a lease goes. We just talked to the manager of a housing complex on Thursday. He said the apartment we will be renting is under maintenance, but we should be able to move in at the end of Jan beginning of Feb.

    Then you two should be quite happy to be moving out. Today. As you agreed upon back on November 30th but, in this time period, appeared to have done absolutely nothing about, simply continuing to accept the good graces of this couple until the wife has blown her stack and wants you out of their hair.

    And the point is....you and hubby have been living with these folks for 6 months, never paying rent.

    You're wanted out. You've been asked politely to move out. You agreed to move out in 30 days. And you apparently dislike this woman - so why would you want to stay?

    Next...if they have to go to court to evict you, they can. HOWEVER - that will show on your record and make it harder for you and hubby to get an apartment. So unless you want to be living in your car, I'd suggest what I already did - get a UHaul, today, get a motel room for a few nights.....

    PS: Have you even started packing?

    I was illegally evicted in July by my roommate and his sister. I was able to pack up, work had a helper for the U-Haul, and was gone in 4 days. You've had 30 days to pack and make arrangements to move....

    One more addition: Should they have to file to evict you...they can also sue YOU for rent for the past six months.
