What Happens when Minors Shoplift in the State of California
My question involves criminal law for the state of: California
Me (15 years old) and my cousin (14 years old) shoplifted from jcpenny the other day we got caught and they took us to their room this is our first offense this was mostly my cousins idea it was both of our idea to go to the mall but I would have never thought about stealing clothes if it wasn't for her she taught me that you can steal clothes from jcpenny and she bought a bag from home to put the clothes which I had to carry out of the store and she had like 4 shirts in her bag so when they caught us her amount was $40 and mine was about $300 cause I was carrying the bag even though it was her idea but we got arrested an finger printed the jcpenny people didn't tell us anything really The police guy said we would probably have to pay something and do community service and that when were 18 we can ask for it to be sealed so it's not on our permanent record but my dad is saying we have to go to court and in scared what's going to happen? Will it stay on my record? How much will I have to pay? Will I go to jail?

Yes, this will be part of your criminal record. The most common penalties are fines and probation for a couple or three years, and possibly some community service. You may also receive a civil demand from the store for up to $500 in addition to any penalties imposed by the courts.
There might be a diversion program in your community that will allow you to pay fines and do your service, and if you stay clean for a year it can be dropped off your record entirely. Otherwise, you will have to petition to have the record sealed after you have turned 18 (assuming you are no longer on probation for the offense).
If this is the only time you cross the law, you should be able to move past it. Consider it a one and only warning.
