Failure to Yield on Left Turn
My question involves a traffic accident in the State of: Utah
I was in the left turning lane, already pulled out into the intersection, waiting to turn. There was one last car that I was waiting for coming in the opposite direction. It put on its right turn signal/blinker and slowed, so I proceeded to make the left turn. Apparently, the other driver changed their mind about making a right and kept straight. Our cars collided. Of course, I was given a citation for being the driver turning left. Is there any way I can fight this, or do I just have to take the citation?

you dont need to fight .. the state needs to prove your guilt .. does not seem too hard to prove it ... did the cop witness what happened? And did you yap yap yap to the cop?

You've lost me. If he was turning LEFT I could see you thinking that you could turn in front of him (even that is NOT a guarantee), but turning right? You should have yielded to him either way. The law doesn't make qualifications on the other driver's behavior. You're obliged to yield to ANY traffic that is approaching in the opposite direction.

You are at fault. It is your responsibility to insure that the intersection is clear before initiating any turns. He could have put on his blinker early to turn into the gas station (or whatever) on the corner across the intersection.
