How to Take Off a Fathers Name on Birth Certificate and Add Real Father
My question involves name change laws in the State of: Illinois
I'm 40 yrs old and just recently did DNA to find my real father, I want to take the man who my mother married off of my birth certificate and add my real father. My real father is willing to do this, but I don't think my mother is happy about this. I have no idea if the man she put on the birth certificate is alive or not, he hasn't been in my life since I was 5.

You can explore adult adoption.
Quote:
Quoting 750 ILCS 50/3. Who may be adopted.
A male or female child, or an adult, may be adopted, provided the other conditions set forth in this Act are met, and further provided, with respect to an adult, that such adult has resided in the home of the persons intending to adopt him at any time for more than 2 years continuously preceding the commencement of an adoption proceeding, or in the alternative that such persons are related to him within a degree set forth in the definition of a related child in Section 1 of this Act.
The full Act is here.

You have to realize that the man on your birth certificate could be your legal father and is rightfully on your BC. As Mr. K alluded to, if you want to change who your father is, the person wanting to be recognized as your father is going to have to adopt you. You don't get to change who is named as your father on your BC simply by proving some other man is your biological father.

To go a little further, an adult adoption would need either Mom's involvement (assuming she's actually with the biological father), or it would result in Mom no longer being your Mom, OP.
If she doesn't want bioDad on your birth certificate, I honestly cannot see a way around this.
