    Caught Spraying Graffiti, Gave Police Fake ID
    My friend got caught for graffiti, but all he had on him was his brothers ID. He just got a citation, they didn't take fingerprints or anything like that.

    The cops think it was his brother, not him. His brother can easily prove it wasn't him (hes in a different state).

    What are the chances of my friend being identified? There may have been video cameras in the cars when we were detained. So lets say, if they have my friends picture. What are the chances that the house on the address of the ID will get raided???
    What are the chances they will have people comparing my friends photo from the cameras in the car to a database of peoples pictures, and how likely do you think it is that they will look for a picture of the brother of the person whose ID it was and compare?

    Basically after they realize they didn't ID my friend correctly, how likely is it that they will look for him and what are the chances they will find him?

    Yup and your friend will be looking at additional charges. The odds are incredibly high that they will find him. Where do you think the first place is they are going to look?

    If you... I mean, your friend fails to appear in court as ordered, odds are they'll issue a bench warrant for his brother. Then, one day when his brother is driving down the street and gets pulled over, visits little brother in jail, or otherwise has his ID checked by the police, odds are he'll be detained on the warrant.

    If big brother is looking at spending a night or two in jail over a weekend because little brother used his ID when committing a crime, I don't think the police are going to have much difficulty getting big brother to tell them who was using his ID.

    After the police arrest big brother and make him squeal, they will likely let him off the hook with providing false identification. Your friend of course, could add theft of the ID, to his other crimes and keep big bro out of it.

    Little Brother better come clean and turn himself in. Otherwise, Big Brother will be in some trouble later. And once it is obvious that Little Brother lied...Little Brother faces further criminal charges; Big Brother can then sue Little Brother over any legal fees incurred....

    What if big brother gets the letter for the court date or whatever and then calls in proving that he wasn't in the same state at the time of the incident? Also, if he says he lost his ID, and doesn't know who has it (which is true)?

    And what if little brother has a new address in a different city and changes his appearance?

    I don't encourage my friend to do this but how do you see things playing out under these circumstances?

    Also, what qualifies as identity theft? The cop never asked if it was him and he never said it was, they just pulled out the ID and wrote the citation.

    Big Bro is not gonna like having a court date for something he did not do.

    And video was likely taken...."Owner of home, do you know this person?" "Why yes, that's my younger son...."

    Your second part of the question....there are things he should have done BEFORE someone used his ID, like report it missing/lost/stolen. And since Big Bro is in a different state....actually...that makes his old state ID invalid.

    Hes in a different state. How is he going to have a court date? Will it be in his state or minnesota?

    The citation didn't say anything about a court date, do misdemeanors always have a court date or do they just fine you sometimes?

    Of course the ID was invalid, the corner was clipped, the cop didn't even say anything about it.

    The owner of the home knows what happened, additionally, they dont currently know little brother at all and have never seen photos of him.

    Look, if the only answer you were willing to listen to was that you...sorry, the younger brother...was scott free and nothing could possibly happen to him, why didn't you say so right at the beginning so no one wasted their time trying to give you the legally correct answers?
