My Mother Got Denied for the Third Time a Tourist Visa

Hi,
I've been a US citizen for the last 5 years, inside that period of time I've applied for a tourist visa for my mother 3 times. She was denied the visa every time.
The consulate in Havana, Cuba, said she is a possible immigrant. This, from my point of view, defies any logic, since I could have applied for reunification, but I did not do it because she does not want to live in the US, she is almost 70 years old and she will not leave her parish and her life. She only wants to com 1 or 2 times a year to be with me and her 2 grandsons for their birthdays.
I understood why she got denied the first time, 5 years ago, but now, after 5 years?, its evident that she does not want to live here, and that I will not apply for reunification, isn't it?
I can not visit Cuba myself because I'm a writer and I'm not welcome there by the dictatorship... So, I haven't seen my mother since 2008 (I went to Cuba for one week and the political police told me to leave the country or else) She hasn't seen her youngest grandson ever and the oldest only one time.. so, is this really logic or fair? I know I can't do anything about it, but I feel terrible today (she was denied today in the morning again!)

You can both select a neutral location where you can meet up, surely?

There is obviously a reason why the State Dept feels that your mother has possible immigrant intent.

I really don't see the reason to think she would end up staying illegally because if she wanted so, I could have applied for family reunification for the last 5 years!!!
I can see you are not familiar with the Cuban dilemma. I can't select any neutral location to meet up because nobody gives visas to Cubans to visit. And I mean NOBODY. They need an invitation form somebody in that hypothetical 3rd country also... and they are denied always. Cuba does not have Visa treaties with any country in the world.
My point here is that there is no reason to believe she will become an illegal immigrant!

And the base point is that it doesn't matter how many people think it's unfair, or illogical. She does not have an inherent right under either US or Cuban law to a tourist visa. You can argue the point till the cows (or the llamas) come home but it's not going to change the facts - they don't want to let her into the country, and they don't have to.

The point is that there is every reason to suspect that she will stay beyond her visa. It's just not uncommon for elderly relatives to try and do so.

CBG is absolutely correct.

Oh, it was clear to me that the Government does not HAVE to let her into the country.
By the way, the only time I've seen llamas is in the Zoo, Cuba is far away from South America, I'm more familiar with cows and sharks.

I guess then I'll never see her again, like with my grandpa, I invited him 2 times and his visa was denied also, he died and I wasn't allowed to enter Cuba to assist his burial. Thanks for the responses guys, peace!

Don't whine to us. We didn't deny your mother's visa.

Did you come to a legal forum looking for legal answers, or just for someone to make soothing noises and tell you how unfair it was?

I think you're the one missing the point.

No one is telling you that you're wrong to be upset. Of course you're upset. There'd be something wrong if you weren't.

But the law does not take compassion into consideration. The law is not required to be compassionate. And our being so is not going to make the law's position change.

Every person here could say, yes, of course it's unfair, and how dare they. It wouldn't change anything.

So, I ask again. Did you come here looking for legal answers? Or for someone to tell you what you wanted to hear?

Well, this is a very different answer than the one you wrote before. I can see a point in it and a couple of reasonable questions. I was looking for legal advise about what to do to change this situation, maybe I gave too much information based on how I feel today and after corroborating that I can't do anything to change this.

This was not meant to you, it was meant for cbg's answer, which I did find offensive. And, from the beginning, after you both explained it to me I understood that I can't do anything.

I suggest you attempt to meet her in Mexico. Very few people want to illegally immigrate there. Belize possibly.
