    Can I Drink Alcohol in a Publicly Visible Area of My Private Property
    My question involves criminal law for the state of: Virginia
    If I am in my own yard can I drink a beer legally? Do I have to be out of site of everybody to be legal. What rights do I have.

    If you are under 21, there is no place in the commonwealth you can consume alcohol legally.

    If you are over 21, then as long as you are not in a "public place"

    Public place" means any place, building, or conveyance to which the public has, or is permitted to have, access, including restaurants, soda fountains,hotel dining areas, lobbies, and corridors of hotels, and any highway,street, lane, park, or place of public resort or amusement.


    So, in your yard of a single family house you're probably OK. In the common area of an apartment that's open to the public, no.

    There are also statutes on intoxicated behavior: disorderly conduct and "profane swearing."
