    Caught Stealing Merchandise and Embezzling Cash
    My question involves criminal law for the state of: New Jersey


    About a week ago I was brought into the security office of which I work at (Macy's) they said they have me on the cameras shoplifting merchandise and pocketing cash total of $986. Long story short i admitted to everything I have done, agreed to pay the store back. they said they weren't going to call the cops if was honest so I was. after the paper signing and overall talking they went outside and I heard them talking to someone. A police officer came in and demanded I give him my social after he got it he left the room and suggested to the security personnel that they should probably file a compliant does this mean I'm probably going to court and/or jail? First offense clean record 21 years old

    It is not the victim (Macy's) that determines if you will be prosecuted. It is society that is damaged by your crime. Macy's might have kept knowledge from the state, but now that the state is cognizant of it, it is out of Macy's hands.

    But dont they have the right to press charges or not that's what I'm worried about because they said they weren't gonna involve the police

    Apparently, the person they talked to called the police. They didn't lie.

    It's not up to Macy's. If the prosecutor decides to pursue this, he does not need Macy's permission.

    The police showed up and obtained pertinent info from you, and presumably them. It appears that the police are definitely involved and your fate, it would seem, lies in the realm of the local prosecuting attorney.

    Before you ask 'How long....?', it could be a goodly while until the report gets filed, the case investigated, and the charge(s) filed.

    It is not Macy's that presses charges. All Macy's can do is inform or not inform the police/state. Macy's is not the one that will prosecute you. It will be the State of New Jersey.

    Most likely mail, but they could come knocking on the door.

    $986 of theft...

    You are facing: Civil Demand from the store for atleast 2-3 times that amount. Court costs and fines. A criminal record that will make it fun to even get a McJob. And you really do need a lawyer to minimize the damage.

    $5K is a good estimate of what I hope you have in the bank or available as credit....

    What are my chances at a pretrial intervention? Also i found out that the civil demand cant be higher than the amount lost which i paid most of already
