Did a judge issue the order? Did you attend the court hearing to contest the order? If you did, and the judge still issued the order, what NEW evidence have you obtained that would show that the plaintiff knowingly and intentionally lied about you or your actions?
You will have a hard row to hoe to sue her absent a confession.
Also, what state is this in?
You cannot sue for defamation for statements made in court
the judge denied the order due to her lack of evidence. it is in wyoming.
There is no defamation here.
And please don't sew her. That will likely end in a prison term. :eek:
TRO's are often handled on a "when in doubt give it out" basis until they can review the situation more in depth. the court is not going to set precident for sanctioning people who request TROs, they are a necessary tool against domestic violence.
And you should stay away from her and for the most part act as if there was a restraining order, because clearly she does not want to have anything to do with you at this time and pressing things will get you a restraining order or a charge for harassment.
I don't care that she was "hiding her friendship" and neither will the cops and neither will her boyfriend. Continuing to make any contact with her now that you clearly know she does not want any will get you one or more of:
Restraining order from the court.
Shiny bracelets from the cops.
Fist in the face from the boyfriend.
I have no intention of seeing her again. I want my costs from this reimbursed. is there any grounds where i could get this?
Ask her nicely.
Anybody can sue anybody else for just about anything. Problem is that you really aren't going to be able to PROVE that she had NO grounds at all to ASK for the order. Lies or not, if you'd been sleeping with her, and she wanted to end that arrangement for ANY reason, the court is going to err on the side of the party seeking the order. As noted above, just because she didn't get one issued doesn't mean the whole exercise had zero merit. ANY iota of merit would be enough to loose a civil case seeking reimbursement.
