Reckless Driving for Speeding > 100 MPH
My question involves a traffic ticket from the state of: California
I had to meet a special someone 330 miles away. But it turned into a nightmare real quick having to drive from Los Angeles to San Jose.
I tool the 101 route thinking I was early, next thing i know it hits traffic. I had traveled 35 miles west from LA, then had to go up, take the 118, more traffic, then the 5, still with traffic.
Finally the traffic cleared in the mountains, and since I was late, i eas going 100+ almost the whole way.
In Kern County, around 100 miles later, a cop apparently 'saw' me, and I dont know how thats even possible, but he clocked me at 113. Now i dont doubt him at all, but how could he have known??
Regardless, I immeadiately apologized and explained my reason, was very cooperrative and he gave me a ticket.
But I believe I already had gotten a ticket for speeding before, going like 90.
Now i was going 113...
Whats gonna happen to me? How can I get out of it? How much is the fine? And how much are lawyer costs if it is recommended??
Also, does the Trial By Declaration method still work if I'm lucky and pray to God the cop does not respond?
Please help guys
Re: Whats Gonna Happen to Me
What makes you think you should get out of it? Why are you entitled to break the law?

I did not go +113 to break the corporate laws designed to save insurance companies more money..
I had to get somewhere, and let me tell u, there were no cars in the way.
Does this mean I can still break it? No!
But I did, and now I need help.
I dont wanna hear reckless driving either. I regularly race and ny 113 is the same as going 55 for most.
Its my average speed and I feel pretty comfortable and at ease doing it.
However, would I have gone that fast? No, I had to make it fast.
Its annoying when someone can pull me over and fine me. I mean its like a prison world we're in.
Governments and laws?? What gives them the damn authority? This contry is going downhill fast. Its nothing like how it was meant to be as envisioned by our founding fathers. Bunch of dumbass laws to boost corporations and put the common man down.
And you know what, the speed limit is 70 because the govt knows most Americans are too stupid to drive any faster, as they will lose control and crash.... And because of the stupid Americans who need the govt to babysit them, I have to be limited to 70MPH like Im being pulled by my legs by a hundred men.
Let go of me and I will give you the secrets on how to join me.
Jesus christ. Cops always do this. Even when im not speeding or doing anything, they'll still pull me over and look for trouble. So much for protecting and serving. These people only protect and serve big corps.
So dont tell me i dont deserve it fool. If you got a 113mph ticket when u have to make it somewhere, with no cars in sight for miles on a straightaway, with the ability to even hit 140MPH like its 65, then this would piss you off.
Re: Whats Gonna Happen to Me
As they say, "If you can't do the time, don't do the crime."
You and Sammy Hagar can team up and lobby for an increase in the speed limit, but until them you're not exempt from the laws - if you want to drive, you need to follow the traffic laws.
Re: Whats Gonna Happen to Me
The others can correct me if I'm wrong, but I'm pretty sure a reckless driving citation is a mandatory court appearance, so a TBD is out for you.

I am thinking in his haste (or is it waste), he is thinking reckless driving but it may simply be a 22348(b). Either way, he could make his first appearance in person, then request a TBD. However, with statements like this:

I think this one is a lost cause.

I wish you luck... Moreso, I wish I am not ever on the same road/highway when you're driving. But I also wish you would repeat this rant in front of the judge... With or without your rant, I see a license suspension n your future; so make sure you have a ride home. Because its a long walk from Kern county back to LA.

No, you just went 113 MPH in excess of the statutory maximum speed of 65 or 70.

Sure it is ... But, I won't give you a "reckless driving" speech as speed, by itself, cannot constitute reckless driving per VC 23103.
Although, if convicted, the court can choose to suspend your license for up to a month.

Why? Booty call? Birthday? Meeting someone on their death bed? Any sob story you can tell to the court?

Nah ... it's a world with laws. You know, rules of civilized behavior theoretically designed to make us safer.

The Constitution of the United States, and those of each of the states.
Gather your pennies and be prepared to pay the state, and, if you make any of these rants to the court, be prepared to also face a suspension of tour license.
Question: What specific code section were you cited for?

I'm taking a vote on which is more of a horrifying thought:
A) Having a hold over this guy,
B) Wanting the "secrets" on how to join him, or
C) Getting the "secrets" and realizing you really screwed up this time!
And please, only vote once!!!
Thank you!

Does the booty call excuse actually work? I've only had that one used against me: "Not tonight dear, I got a speeding ticket."

I've seen it work, but not in California. There were pictures involved as well. Nor was it 113+.

That depends on who the call is with, I suppose.
Re: Whats Gonna Happen to Me
Stop whining and go to Mexico, if you want to drive that fast. Merdida is your friend.
