    Statutory Rape and Pregnancy
    My question involves criminal law for the state of: California. Im a 16 year old female, about to turn 17 in 2 months and i am about 7 and a half months pregnant and have a relationship with a 22 year old. He just turned 22. We have been together for over 2 years and 3 months we love each other very much, we both even have tattoos of our initials and date when we started dating. We are worried about what would happen to him if anyone finds out. My mom knows but doesn't really care but my dad doesn't know and does not like my b/f because of his age. We plan on telling him but are afraid of what he might do. My b/f obviously wants to be there for me and the baby and wish to get married later on in life. My question is, if my dad decided to report it or whatever, what would happen to my b/f? Any advice would be appreciated.

    Okay ... so, HE has committed a felony and the evidence of that felony is residing within you. AND! Whoever gave you the tattoo also committed a crime unless you had parental permission.

    They are going to find out. You are underage and pregnant ... kinda hard to keep secret. What could happen is that he gets arrested and can go to county jail or state prison

    What will happen? He will likely go to prison and be forced to register as sex offender for the rest of his life

    The age of consent is 18 in your state; he is more than 3 years older than you; there is proof positive that you had underage sex. He has committed a crime - there is undisputable proof of it; the law does not recognize true love as a defense. The doctor who delivers your baby is a mandated reporter. One way or another, this is going to come out whether your dad reports it or not. Your boyfriend needs a lawyer yesterday - he has committed a felony and the state will have NO problems whatsoever proving their case if they decide to pursue it. Which is not something that you, your boyfriend, or your dad can influence.

    As a note, in CA unlawful sexual intercourse per PC 261.5 is not a registerable offense. Though if he were charged with other related offenses he certainly could be required to register.

    And, PC 261.5 is only subject to mandatory reporting when the minor is under 16 and the perpetrator is 21 or over. As she is 16 and almost 17, it is possible that the doctor may not report this. But, many doctors err on the side of caution and will report it. And when she shows up at school pregnant, the school almost certainly will report it. Once the matter gets to the attention of the police or CPS the boyfriend is in deep kimchi!

    there are some simple thigs you could keep in mind. like the Right one has NOT to incriminate themselves.

    They really won't need an admission in this one. I've dealt with a great many of these cases, and they really are rather simple cases to make even if everyone shuts up.

    many women 17 to 47 walking around pregnant by themselves or with no clue as to who fathered their child. If she plays dumb she won't look too suspect. I would suggest you find the statute of limitations on stat. rape and then let that clock start ticking on your 18th bday. I would suggest he not sign the birth certificate which is no huge deal these days or even 3 decades ago.. I wouldn't be around him too much in front of people who don't agree with the relationship or just don't like one of you because they might bug a detective enough to get him looking your way. Just create a private relationship between your baby and his father. If anyone asks hes baby sitting, dont address their links, dont give any information that dates you, the child, the father, make math next to impossible.

    Oh - one other thing. If ANYONE even mentions his name? The State can COMPEL a DNA test.
