Car Was Towed from Apartment Complex Because of Stolen Parking Sticker
My question involves a traffic citation from the state of: Columbus, Ohio

This morning, 11/21/2012, I realized my car was towed from my parking spot at my apartment complex. I called the tow company and they stated it was because I had no parking sticker. I realized about three weeks ago that my sticker was missing/stolen. I advised the rental office ASAP. She left me a voice message (which I still have) stating that if I give her my vehicle info, she would make sure to tell the towing company. I thought everything was okay until this morning. I spoke with the rental office and she advised me that she had got my voicemail with my vehicle info and they had told the towing company, however, they had left me a voice message on that same day telling me to come get a new parking sticker. I never received that message. Now, they are refusing to help with this and are telling me that I have to pay to get my car out of tow. I have lived here two years and never had an issue with parking or towing. If I would have recieved a message to come get a new parking sticker, I would have stopped by the office and got one. In her message she stated that we are only allowed two parking stickers so I assumed that since I already had two (one that was stolen and one on my babysitter's car) she was not going to give me a new one because I am also moving out at the end of this month. Do I have any leg to stand on here or am I just going to have to eat the $110 dollars the tow comapny is charging to pretty much steal my car and drive it two miles down the road? Any insight on this would be helpful!!

I think your #1 priority is to get your car out because the longer it stays there the higher the storage fee will be.

As for a leg to stand on, it will likely boil down to being your word against theirs and it could eventually go either way; they say they left you a message, you say they didn't... However, if you take it a step further, it was really your responsibility to run down to the office to get a new sticker even if they failed to leave you that message that is in question, and so I still see it being your responsibility to ensure you're in compliance with the rules.

Typically when a vehicle is towed in error of the property owner, the towing company will release the vehicle to the owner at no charge. This is in the contract between the property management and the towing company.

I'm not saying that your vehicle was towed in error. What I'm suggesting is, if you are polite with the property management, just maybe they can get the vehicle released to you at no charge.
