Providing Alcohol to a Minor to Procure Sex

My question involves criminal law for the state of: NY

An 18 yr old high school student was given alcohol on several occasions by a 28 yr old male. This individual attempted sexual contact on 3 occasions and the female prevented further contact on each occasion. On three occasions there was kissing once the teenage girl was intoxicated. She had zero.experience with alcohol prior to meeting this 28 yr old male. On one night, she was so intoxicated that she could not sit upright or stay away awake. He suggested she lay down inside a roo
where in the dark she fell into bed,very dizzy and unable to stay awake. She felt him join her from behind and lost consciousness. Her next recollection was waking up in the midst of intercourse. She struggled in and out of consciousness for about 3 minutes. Is there a criminal charge when an adult provided an underage person alcohol for purposes of sexual contact. Thank you.

It's a crime to provide an 18 year old with alcohol, period.
The rest of it sounds like rape (alcohol or not).

I agree. It's is rape. I want to remain vague on the young woman's history but suffice to say predatory males find vulnerable, weak and fatherless teens like one of those big cats who senses the specific gazelle who will go right down. She was victimized as a preteen for a yr. She is not strong enough to have him charged with rape so I'm hoping there's more than a contributing to the delinquency charge. Thanks

The blood bank people (nor my wife) didn't think it was funny when they asked me if I had ever given drugs or money for sex an I responded with "other than my wife?"

Your friend really should report this guy. Tell her that if he can do this to her - he is likely to do the same to some other young woman. If she can't come forward for herself, she should come forward to prevent another young woman from being raped by him.

I agree it's two crimes, not just one. This situation absolutely needs to be dealt with by law enforcement.
