Is My Wife's Home at Risk Over My Child Support
My question involves child support in the State of: INDIANA
Ex is wanting court to revisit CS and order College payments. My new wife owned a home when we married. We don't make much (28K and 22K) and the house is part of our retirement plan. New wife is worried the court will order me to take out mortgages on her house for my daughter's college tuition. Is this possible? Aren't her assets off limits, since she is not responsible for supporting me children? We have always kept separate checking accounts and have never co-mingled our assets.
My ex does not (or rather,chooses) not to work though she has a college degree, and feels she doesn't have to contribute to college. I am more than willing to help my daughter as best I can, but need some insight on my situation with my new wife's assets.

Your child is how old, and the order says what about college costs?
Let's say the child is two. We're not in a position to promise you that in sixteen years you won't have engaged in acts that render the house a marital asset.
Your ex- is not a party to the support case, so absent evidence that she's complicit in hiding your assets the court's not going to order her to do anything.

Child is 18 and senior in HS. Original divorce order says "we agree to meet during summer of junior year to discuss college". Due to distance we talked on the phone and I indicated I would be able to help with $3000 a year or so.
I have been remarried for 8 years and we have separate checking, savings, etc. The house in still in her previous name.
What acts do you refer to that would render house a marital asset????

Lots of factors can cause a premarital separate asset to be deemed a marital asset, including how payments are made, how it's financed or refinanced, how improvements are paid for, etc.

No payments, no financing. Wife owned home prior to our marriage and she made all payments through payoff. My income is so low and I pay lots of extras for the kids, so all I can do is contribute to utilities and food. She pays for anything to do with the house. It is her only means for retirement and, at 59, she doesn't want to/can't lose that.
