Charged with Disorderly Conduct While on Probation for DUI
My question involves criminal law for the state of: Indiana. I'm currently on probation for a DUI and I was charged with disorderly conduct (tumultuous conduct) after getting into a verbal argument turned physical with my brother in our house. Neither of us pressed battery charges but we were arrested anyways. We spent about 8 hours in a holding cell and were released after the guards decided that we were not a threat and they were overcrowded. I was very respectful to the arresting police officers and the jail staff.
So I contacted my probation officer the day I got out of jail (about two months ago) and he told me to contact him when and if I received an appearance date for the disorderly conduct charge. That came in the mail today and when I called him he hesitated for a moment. He than went on to tell me that although he would rather not schedule a revocation hearing, he really had no choice since it was a disorderly related charge. I told him I understood and he said that I shouldn't worry about doing any jail time, but I need to figure out something to tell the judge (an explanation as to why I was fighting with my brother).
Typically I would not be so nervous about this, but I have never been on probation for a DUI (first DUI), and I have never violated my probation in the past. I also haven't been in trouble in 4 years besides the DUI and the new disorderly conduct charge. I should also mention that I spent 30 days in in-treatment rehabilitation for alcoholism right after getting the dui. Also, I was sober when charged with disorderly conduct (which wouldn't have been the case years ago). One more thing, although I haven't found employment, I did just enroll in college for this coming Spring. So all in all, I have been doing pretty well in the 5 months that I have been on probation.
What can I expect? I live in Northwest Indiana, if anyone has any advise it would be great. Also, I don't have money for a lawyer since I spent it all on school and rehab. What should I do? I mean, I'm not a bad guy, just a drunk. Definitely not a criminal. All my previous charges have been alcohol related also. Any advise, anyone?

What are you doing, right now, to maintain your sobriety? Do you attend meetings? If so, consider logging them. Do you have a sponsor? Do you have a counselor? What can you offer the judge to send the message, "I'm trying very hard, and I'm on the right path"?
