Re: Texas emancipation and having a job
I have a few questions please, I am 17 i will be 18 on april 15 2007. I have been having some problems with my mom lately. she had a guy living with us that was overage and we became sexually active. she found out went crazy filed rape charges had me tested for everything known to man kind. ok this december it will have been a year ago. But she still brings it up every day telling me about how much of a slut I am and about 60% of the time when she gets mad at me she proceeds to punch me and kick me I don't hit her back when she does this even though I think it would be considered self defense. she does this in front of my little brother and sister who are 14 and 8 years old I have a job and my boyfriends parents are willing to let me live at their house if they would like me to pay rent then I am capable. I have already graduated high school. My mother says that the only reason that she keeps me in her house is because she is responsible for me and cannot put me out. But in the same breath says that if I try tom become emancipated that she will have me proven incompetent. she also says that it is completely legal for her to take all of my paychecks and spend than on herself. I have to use my tips from work to support myself right now. Is it legal for her to take my paycheck when I get paid and not let me have any of it?? By the way my job is full time and I get paid about 500 dollars every two weeks. I work about 30-40 hours a week. These are my questions and I would appreciate greately if someone could help me out on this.
thank you so much Cathie E.
Re: Texas emancipation and having a job
Typically, states permit parents to take the wages of their unemancipated children. States like California have modified that rule, due to the fact that there are so many kids in that state who have extraordinary incomes due to the entertainment industry, and so many of them have historically had their parents squander their earnings.
Did you read the other threads on Texas emancipation, so you can see what you need to establish? It sounds like you're a reasonably good candidate.
