Notice of Correction Issued for a Speeding Ticket
My question involves a traffic ticket from the state of: California
Please help me with this, I was in a rush going home because of some family emergencies and was speeding 100+. The officer pulls me over and cites me with 22348(b) even after I honestly told him something serious happened to my family member. But I don't get the courtesy notice in the mail for a very long time (3 months?) . Then I finally get a mail in it was a "Notice of Correction and Proof of Service" on it was Clarification of Speed: 75+. so I was kind of relieved to think that the ticket was actually lowered, but just today I received the courtesy notice in the mail and the amount due is $930 for a court appearance? Violation code is still 22348B shouldn't it be something else because the officer filled out the correction and put clarification as 75+ ?? Please help me. Thank you for your time.

If they did not change the code section, then there may be a problem. A violation of VC 22348(b) requires that you be traveling in excess of 100 MPH. The officer may have written 75+ on the correction, but unless he testifies that you were traveling greater than 100 MPH then its all a bust.

Thank you for replying. so you're saying If I show up to court with the notice of correction I should be good. and the ticket should be corrected in court unless the officer somehow testifies that I went 100+?

You said that you waited for 3 months for a courtesy notice ... did you miss the court date that was written on the citation?
The first hearing is the arraignment, that is where the charges will be read to you. You should know what the specific offense is by that time.

no i didn't miss it i lost the ticket, I went to court to try and schedule a court date and the clerk said my ticket didn't exist in the system. so all in all I thought the ticket got lost and officer didn't file it until now

OK, so the officer wrote 75+ on the form and that is all that he mentioned/referenced on the correction form TR-100? Was there a different code section that was corrected as well?
How about you do this... Redact all personal information of the correction form, scan it, upload it to photobucket.com and provide us with a link.
Well, the courtesy notice itself ewhich shows the $930 bail amount should also show what code section was filed with the court...
Additionally, you can go to court and request a copy of the citation that was filed in the case... That will tell you what code section you're being charged with.

I'll definitely do that when I get home, but on the courtesy notice the court filed the ticket as 22348B which is the 100+ my question was. would the correction hold up in court and get my ticket changed? I thanks a lot guys for helping

It may need to be confirmed with the officer (simply because he is supposed to submit a copy of the correction with the citation when he files it... If he didn't, it may seem odd). When he does confirm it though, it sure will hold up... There maybe some logistic complications however; for example, if the court wants to inquire with the officer for clarification, and simply because the officer will not be in court at the arraignment, it may require you to plead not guilty, and have to reappear for trial. To do so would usually require the defendant to post bail for an amount equal to the fine amount, and for the court to require you to post a good chunk of money for bail when it may not be needed and simply because the officer made a mistake, might be a challenge... This is only but one over analytical scenario... There maybe others, of course!

I hope the judge is nice and just accepts that notice of corrections that the officer originally wrote up. Thanks again for all the help!
