16 Year Old Charged With Alcohol Possession
My question involves criminal law for the state of: Georgia
My 16 year old son was in the car with an underage girl, who has a previous record for drug and alcohol possession. When the car was searched there was pot underneath the girls seat and a bottle of vodka underneath the seat my son was in. Neither item belonged to my son but she was charged with the pot and he was charged with possesion of the alcohol. He didn't even know it was under the seat. Is there any need in fighting this charge as it is his word against the officers? They wouldn't give him a breathalizer (said they weren't charging him with consumtion just possession).

Since it was under your son's seat, the police charged him with it. "He didn't know it was there" is heard many, many times.
I would expect him to be ordered to undergo Probation, and also be placed into an Alcohol Education class, and lose his drivers license. You can also talk with a Criminal Defense Attorney.
And get to know your sons friends and their reputations better, know who/when/where/why/how....

Legally speaking your son is toast. Morally speaking, he is very likely lying to you, so you are not mad at him. Whether they actually reached the point where it was to be consumed is irrelevant.
