How to Answer Job Application Questions After a Deferred Drug Felony
My question involves labor and employment law for the state of: California
I have a felony charge for furnishing marijuana, but my charges will be sealed and dismissed in 1 year, i'm 15. Question is, how do i answer a question that says have you ever been arrested( i have), have you ever been convicted of a felony, or have you ever had a juvenile adjudication???? My PO sais i can put no on all of them and that she's checked some of her other kids records and was unable to find any record.
Re: How Do I Answer Job Applications or Interview
California employers (with the exception of certain government positions or those requiring a security clearance) can NOT ask about arrests - only convictions.
And how do you KNOW your charge will be sealed and dismissed in a year? I have heard that one before, and many people have been surprised to find that their records were not. In a year, have your parents check with the attorney and the court to make sure it has happened. In the meantime, unless you have NOT been convicted (or had a true finding in juvenile court) you will likely have to answer "yes" if asked if you have been convicted of a criminal offense.
There are consequences to one's criminal actions.
