    My question involves juvenile law in the State of: Indiana
    Hello , My 19 yr old daughter , who still lives with me has been having attenance issues in school this year .
    I just got a letter stating that I have to go to court because of her attendance I told them that she is 19 now and I'm tired of dealing with her .
    They said until she is emanicpated I am still on the hook for her , I can't find anywhere that says I can emanicapte her ! They said I signed the school policy ( which is to enforse the state laws which are for 17 and under ) and that I can still get in trouble , how can this be ? I also got paper work from Ohio stating that she was emancipated at 19 and even the new law in Indiana says 19 now ( these are for child support ) . Also I signed the contract for her school this year before she turned 19 on Oct 17th . My question is will this hold up in court and if not how do I go about getting her emancipated when she is already 19 yrs old ?

    well, not sure what law they are attempting to invoke but here is an excerpt that would help you.

    Application
    Sec. 3. This chapter applies to each situation that involves any of the following:
    (1) A person less than eighteen (18) years of age who is domiciled in Indiana.
    (2) A person less than eighteen (18) years of age who:
    (A) is not domiciled in Indiana; and
    (B) intends to remain in Indiana for a period established by rule of the state board.
    (3) A student:
    (A) who is less than eighteen (18) years of age;
    (B) whose behavior has resulted in an expulsion from school; and
    (C) who is assigned to attend:
    (i) an alternative school; or
    (ii) an alternative educational program.
    As added by P.L.1-2005, SEC.17.

    If they demand you comply with the Indiana state law, I would bring this section of law to their attention:

    Of course they can take punitive action against your daughter such as suspension or expulsion.

    Are there special circumstances here, such as your daughter being 'special needs'?

    Thank You JK , that is what I have found too and I have no problem with them punishing her through the school but can't figure out what they mean by getting her emancipated .

    Mr. Knowitall, no she has never been special needs or anything like that , just a regular student . My oldest daughter has always been straight A's and is now in the Army but My second daughter even with tutoring has never done well or liked school . And I have to point out that she could drop out without my permission if she wanted .
