How to Collect Child Support from Non-Paying Out of State Dad
My question involves child support in the State of: Michigan

I live in Michigan and I have never received any child support from my son's dad who lives in Colorado. There is a support order from here in Mi. and as of August 2012 this dad is in arrears almost $5,000. In August I received a copy of a "Notice Of Intent To Report Child Support Debt To Credit Reporting Agencies" from the State that was sent out to him, yet so far this hasn't prompted him to do the right thing. He is self employed and so he has no worries about having money withheld from a paycheck. I am wondering what my recourse is. Or whether there even is any recourse for me. Will a bench warrant eventually put out for his arrest over this? I should add too that there is a current Personal Protection Order against him until August of 2013 and that he has supervised visitation whenever he does come to Michigan which is infrequently.

    Thank you sincerely,

Re: What Recourse Do I Have to Collect Child Support from Non-Paying Out of State Dad
He will eventually face unpleasant consequences of refusing to pay child support. This may range from damaging his credit rating to license suspension to jail, with many other things in between.

Understand that you are only one of many thousands of single parents unable to collect support, and an overworked agencies that can't keep up. The notice of intent you saw is automatically generated, and not the result of someone actually taking much time, if any, on your problem.

You need to become your own advocate and go online and fully educate yourself on the child support enforcement laws of BOTH states. Only then will you be able to fully understand what your legal options are, and in turn know who to contact and which buttons to push and when to file actions in court. This to make his non-compliance so painful that he will start coughing up what he owes to his child.

Hopefully that will be long before jail time is necessary or rises to the level of what Michigan considers felony non-payment of child support.
