    Transfer Expired H1b Visa After 3 Years to a New Employer
    Hello,

    I am in a difficult situation here since I really want to stay in the US and keep working. My H1B visa expired after 3 years (no extension filed) and I left the country according to the date on my I94 (Visa exp. 09/11/12 - i94 exp. 09/12/12). I have employers who would hire me and take over my visa now for the remaining 3 years (10/25/12) - is this possible at this point that the first period expired? Or will it be a completely new application process subject to the cap and with starting date Oct. 1st 2013? I would be doing the same job for a different company.

    Your new employer would apply for a H1B visa for you. From what you have told us you have been counted against the cap for the next three years.
