Finding an Innocent Explanation for Drug Related Texts
My question involves criminal law for the state of: South Dakota
The police found little tiny flakes of Marijuana in my car
They have had a few people claim they bought Marijuana from me
They took my phone and looked through all my deleted texts as well. In my texts they will find people asking for "1g" and "1" and similar texts. Here is my question:
-Can I say that the people texting me were asking for "g-puff" cigar wraps?
My brother is 18 so he could legally buy them. I know I could get possession for the tiny flake or 2, but are a few texts a week of people asking for "one" enough to convict me of distribution even if I have a legit excuse to have those texts?
All the information they have against me is people claiming I sell, and those texts

Those texts are very incriminating. So is that box of sandwich baggies. This is evidence against you, along with all the people who claim you sell.
As someone already stated, you can bet you have sold to an undercover cop or an informant, who will be ready to testify against you in court.
The judge and prosecutors have heard it all before.. And no one asks for 1g of g-puff cigar wraps, which they could purchase themselves. If the person is not legal age to purchase - you're just digging the hole even deeper, admitting you purchase products for underage people.
Lies and bullshit will only get you on the bad side of the prosecutor and judge. Get yourself a Criminal Defense attorney, and see if you can plea down or get a Diversion Program. If you get a Diversion Program - you only get 1 shot, so don't mess it up -in short, quit dealing, quit smoking pot.....

There is going to be a search warrant in your case, so tell us what allegations are made on the affidavit. I expect that there is either a claim by one or more informants that you sold them marijuana, or that there was at least one controlled buy, perhaps both.

They said that kids that "bought" from me ratted me out. However, none of these people would testify in court against me. I was just wondering if I had an excuse that says Im "selling" cigar wraps instead of marijuana, it would get me out of the distributing marijuana charge.

But they didn't find cigar wraps,did they? They found marijuana. Why should they believe you were selling anything else?

Want to bet? They don't have a choice and if they rescind their prior claims, it makes them look like they are now lying, especially since based on their information, you were arrested and charged.

...and if they don't testify, THEY risk being arrested.
So which would you do? Testify? Or go to jail yourself?
And again, atleast one is likely a person who bought from you as either an informant (with police supervision), or an undercover cop. Your word versus theirs....whose gonna be believed?
You also have multiple people saying you sold to them...if there are even 5 people saying that...that is 5 saying you sold to them vs 1 person, the accused, saying they did not....see how these odds are not in your favor?

I'm going to kill myself I'd I get convicted of distribution of marijuana. Honestly. I have it perfectly planned. But thanks for the help guys. Just looking for some help and maybe some hope. But I guess my life will be over. Very soon
