Caught With Baggies and Trace Amounts of Marijuana

My question involves criminal law for the state of: South Dakota
The police got a warrant to search my house and car. This is what they found:
-2 tiny flakes of Mariujuana
-a box of sandwich baggies

That is all that they found. They also took my phone and looked through all the deleted messages. There are a few that say "hey can I get one?" and "can I get 1g". Now the main question is- Can they convict me of dealing just because I had some messages like that? Not hundreds but maybe 20ish messages. Or could your lawyer argue that it doesn't say "can you sell me marijunana or something more specific than just "one"?

Also, they can convict me of possession because of the tiny flakes of weed, but what would the punishment typically be for that?

Are you telling us that you have been charged with dealing?

If your customers are routinely ordering drugs from you, and when the police catch you they find that you're receiving orders, are in possession of baggies consistent with those a dealer would use, and have trace amounts of drugs in your possession, that's enough to get your trafficking charge before a jury. How many people other than drug dealers have "20ish" orders for drugs in their text message history?

You haven't tried to blow smoke up our skirts about the messages not being orders for drugs, but if you were to try what song and dance would you try to put on for the prosecutor? The guy who ordered 1g was looking for... what? Also, now that the police have the information necessary to contact the "20ish" people who placed orders, some of whom may be facing other charges or may be on probation, what would you expect them to say if the police knock on their doors?

Also, what type of smart phone is this? (Brand and model.) There may be a lot more information on the phone than you realize.

If it makes you feel any better, I believe you haven't dealt much. Conducting such business via text message is a rookie mistake.

I'm going to kill myself I'd I get convicted of distribution of marijuana. Honestly. I have it perfectly planned. But thanks for the help guys. Just looking for some help and maybe some hope. But I guess my life will be over. Very soon

It's your choice, just like it was your choice to deal dope. If you want sympathy, I suggest you engage a professional counselor or have a nice chat with your mother or significant other.

Seriously - if getting caught terrifies you, why didn't you stop selling drugs after the police found your grow op?

This isn't a joke. With that money I earned I set up several organizations for the poor inmy town. I donated over $12,000 to the numerous churches in my town. I also invested in my future so i can have college paid or by the time im out. I didn't just blow it on stupid flashy things like every other kid would. And if my whole life is going to be ruined because of this, I don't want to be on earth any more. I believe I have my spot in heaven, with God waiting. And just what do you think a message board can do to help you out of the hole you dug for yourself? We can't stop the DA from prosecuting you, if that's what he wants to do. We can't decide what sentence you get or even what you are charged with. Just what kind of "help" are you anticipating?
