Mother Keeping Children on Their Father's Visitation Time
My question involves a child custody case from the State of: Missiouri

My Borfriend has a set of Twins... The twins mother is continuosly keeping the children on his weekends of visitation she lives 5 hours from us and we are supposed to meet half way everyother friday. This is the weekend we are supposed to meet them and she is claiming that she is having car trouble and cant meet us with the kids. So we told her we would drive all the way there and she can drive to our house on sunday to pick them up and she is not agreeing to that and said that we can not have them.. This is not the first time she has done this.. We want to know what the consiquences are for her for keeping the kids on our weekend to have them?

    Disagreeable
Re: Mother Keeping Children on There Fathers Visitation Time
Your bf needs to document attempts to get the children. Your bf needs to file for contempt.

You cannot do anything. These are not your children.

Boyfriend can go to court and ask that she be held in contempt for refusing to follow the court order. He should also ask for a long distance parenting plan as a 5 hour distance is really too far for an every other weekend schedule. He should ask that receiving parent picks up so that he gets the twins and if she wants them back, she comes and gets them.

This weekend, he should drive to her house with a copy of the court order and pick up the kids. If he can afford it, he may want to just stay at a hotel in her town and let the kids show him around their town. (How old are the twins?)

I am aware that I can not do anything I am simply there for support of him and the kids... He is actually in the process of going back to court to get the parenting plan modified.. The parenting plan states that he is to pick the up every other Friday at 5 pm but he goes to work at 3 pm. Therefore I go and pick them up just so he can have is weekend with them. The papers do not state that he has to be there to pick them up they just say they are to be picked up at 5 pm so what shall he do just let her get away with not letting him have his kids this weekend or should he just tell her that we are driving all the way to get them and her find a way to pick them up? The twins are 5 and the love coming to our house cause they have a brother here that they love spending time with and also lots of other family they love to see!
